FINAL REALITY™ LICENCE

These are the terms and conditions of licence of Final Reality™ granted by VNU Business Publications Limited (‘VNU’) to you. On clicking on to the next stage, you are deemed to accept these terms and conditions. If you do not wish to accept the terms and conditions, you must not run or otherwise use Final Reality™.

1. GRANT AND SCOPE OF LICENCE

1.1 VNU grants to you a personal, non-transferable and non-exclusive licence to use one copy of VNU’s proprietary product, Final Reality™ on a single computer system.

1.2 You will not copy, reproduce, translate, adapt, vary or modify Final Reality™ or otherwise reconfigure Final Reality™.

1.3 You shall be responsible for loading Final Reality™ on to your single computer system and for supplying any other operating supplies and supporting accessories.

2. COPYRIGHT

2.1 You acknowledge that Final Reality™ is owned by VNU and is protected by United Kingdom and international copyright laws. Final Reality™ and all parts thereof and all copyright, patent and other intellectual property rights remain the property of VNU and no rights pass to you under this Agreement.

2.2 Copyright and other proprietary notices in or on Final Reality™ shall not be deleted or altered by you.

3. WARRANTY

3.1 VNU warrants that it has the right to license Final Reality™ but otherwise Final Reality™ is licensed on an "as-is" basis without warranty of any kind, express or implied, oral or written including, without limitation, the implied conditions of merchantable quality, fitness for purpose and description, all of which are specifically and unreservedly excluded. In particular, but without limitation, no warranty is given that Final Reality™ is suitable for the purposes intended by you.

3.2 VNU warrants that Final Reality™ will be supplied using reasonable care and skill. VNU does not warrant that Final Reality™ supplied is error-free, accurate or complete.

4. LIMITATION OF LIABILITY

4.1 VNU shall not be liable for any claim arising out of the performance, non-performance, delay in delivery of or defect in Final Reality™ nor for any special, indirect, economic or consequential loss or damage howsoever arising or howsoever caused (including loss of profit or loss of revenue) whether from negligence or otherwise in connection with the supply, functioning or use of Final Reality™ or any breach of the Agreement.

4.2 FINAL REALITY™ CONTAINS FLASHING LIGHTS AND VIDEO PATTERNS

Epilepsy, Migraine and Seizures: Some people may be predisposed to experience epileptic seizures, migraine or to lose consciousness momentarily while viewing certain kinds of flashing lights or patterns seen in some video, computer games or graphics. People who have not had any previous seizures may still have an undetected seizure condition. If you or anyone in your family has experienced symptoms linked to such a condition (either seizure or momentary loss of awareness), consult your physician before viewing Final Reality ™

5. GOVERNING LAW

This Licence shall be subject to and construed in accordance with the laws of England and you hereby submit to the exclusive jurisdiction of the English courts.
